BY USING THIS PLAYON® WEBSITE OR THE PLAYON® MOBILE APPLICATION TO ACCESS ONLINE PLAY AND THE LOYALTY PROGRAM, YOU AGREE TO THE FOLLOWING TERMS AND CONDITIONS GOVERNING THE KANSAS LOTTERY PLAYON® ONLINE PLAY AND PLAYERS LOYALTY PROGRAM:

Overview of the Program

The Kansas Lottery PlayOn® Online Play and Players Loyalty Program ("PlayOn®" or the “Program”) offers you a. the opportunity to (i) purchase and play select lottery games by adding funds to a digital wallet, (ii) collect points ("Points") by adding funds to a digital wallet, submitting currently eligible Kansas Lottery second chance Instant, Pull Tab, Fast Play and Draw Game Tickets via code entries, and through other promotional events and activities offered by the Kansas Lottery. (iii) You may use your Points to participate in drawings and other promotional offers for cash and other prizes and (iv) access various information, scan tickets, participate in activities, promotions and other services related to the Program (collectively, our Services).

PlayOn® Online Play and the PlayOn® Players Loyalty Program may be accessed through either the PlayOn® website (found at playonkansas.com) or the PlayOn® mobile app (available through the App Store or Google Play).

Transactions made using the PlayOn® website or the PlayOn® mobile app are governed by these terms and conditions. Please review them carefully. They affect your legal rights and obligations.

I. INTRODUCTION

Definitions. As used herein, “these Terms” refers to these terms and conditions; “Services” refers to all services, functions, and features available to you through the PlayOn® website or the PlayOn® mobile app; “online” refers to use of the internet or any other means to access the Services; “account” refers to a Kansas Lottery PlayOn® Online Play and Players Loyalty Account registered through the Program; “we,” “us,” and “our” refer to the Kansas Lottery, its agents, contractors, sub-contractors, and third parties involved in producing or delivering the Services; and “you” or “your” refers to you, the “account holder” or the “player”.

Acceptance of Terms. By applying for and using an account or the Services, you hereby accept and agree to be legally bound by all of these Terms. If you do not accept and agree to be bound by any of these Terms, you should not apply for an account and are not authorized to use the Services.

Terms Subject to Change. The Kansas Lottery reserves the right to change the Program as well as update or revise these Terms at any time and in any format or to terminate the Program with or without prior notice to its account holders. Any modifications to these Terms posted on the PlayOn® website or the PlayOn® mobile app will become effective immediately. You are responsible for reviewing these Terms periodically for any such modifications. Your continued participation in the Program means that you accept all such updates or revisions. If you do not agree to these Terms, as amended from time to time, your only remedy is to discontinue your use of the Services and/or to cancel your account.

These Terms, game rules or instructions, additional terms or eligibility criteria pertaining to activities and/or promotions, our privacy policy, and any other documents referred to herein, constitute the entire agreement between you and the Kansas Lottery, and define all your rights and obligations in your participation in PlayOn®. If there is any conflict between these Terms and any other rules, instructions or criteria posted on the PlayOn® website or the PlayOn® mobile app, the Kansas Lottery shall resolve the conflict at its sole discretion. Violation of Terms. The Kansas Lottery may take any lawful action we deem appropriate in response to an actual or suspected violation of these Terms. This includes, but is not limited to: suspending or terminating your account; blocking access to the Services; withholding your withdrawal of any funds pending completion of an investigation; invalidating a purchase; refusing to award a prize or reclaiming a prize that has been awarded; reporting and providing information about your actions to any third party, including law enforcement; cooperating in any investigation; and initiating or participating in any civil or criminal action. By violating these Terms, you waive and forfeit any claim to a prize or any portion of a prize.

II. USE OF SERVICE

Participation in the Program. Any activities associated with PlayOn® are void where prohibited by law. The Kansas Lottery PlayOn® Online Play and Players Loyalty Program is administered by Pollard Banknote Limited for the Kansas Lottery. PlayOn® is a registered trademark of Pollard Banknote Limited used under license.

PlayOn® is provided to individuals only. Corporations, associations, or any groups may not participate in the Program. Persons prohibited from purchasing lottery tickets by K.S.A. 74-8719(a)(1-4) are prohibited from participating in any PlayOn® promotions and offerings.

The Kansas Lottery does not tolerate explicit, abusive, or otherwise inappropriate comments towards their staff or vendors. Any account holder making such comments may be subject to Violation of Terms.

You are solely responsible for all activity on your account and for the security of your computer systems. You are also responsible for ensuring that the contact information provided for the account is current and valid. Failure to keep such information updated may result in forfeiture of prizes.

PlayOn® account holders are subject at all times to these Terms, our privacy policy, Kansas Lottery rules, regulations, policies, directives and procedures, the Kansas Lottery Act and other applicable state and federal laws. These Terms apply no matter how the programs described herein are accessed, whether by home computer, mobile device, and/or any and all other devices. Your participation in PlayOn® is voluntary and conditioned upon your acceptance, without modifications, of these Terms and your certification that you meet the eligibility requirements set forth in these Terms, as amended from time to time.

General Requirements. To participate in loyalty activities, add funds, play eInstant games and/or purchase a lottery ticket online, you must: be at least 18 years of age; have an account; have sufficient funds in your account to make the purchase; be a bona fide resident of the United States or a United States Territory, be physically located in Kansas at the time of adding funds and purchase; and be in compliance with federal, state, and local laws, these Terms, and all Kansas Lottery directives, rules, and regulations. You agree not to use or attempt to use the Services in any way that:

  • violates any federal, state, or local law, regulation, or court order;

  • misrepresents your identity or personal information;

  • intentionally circumvents any method we use to verify information about your age, identity, or physical location;

  • purchases a lottery ticket while you are not physically located within Kansas;

  • impersonates another person, business, entity, physical location, or IP address;

  • allows any third party to use your account;

  • attempts to reverse, deny, charge-back, or otherwise block our receipt of any funds you have added into your account;

  • transfers any funds derived from an unlawful or fraudulent activity into your account;

  • could be considered money laundering;

  • accesses, collects, or stores personal information of another person;

  • accesses or circumvents any of our security measures;

  • gains or attempts to gain unauthorized access to the Services or any of our computers, networks, servers, data, code, or other equipment or information of any kind;

  • damages or overburdens the Services or any of our computers, network, servers, data, code, or other equipment or information of any kind;

  • modifies or interferes with the use or operation of the Services;

  • alters, damages, deletes, or otherwise affects any software or code used for the Services;

  • introduces a computer virus or other disruptive, damaging, or harmful files or programs;

  • violates our proprietary or intellectual property rights in any way; or

  • violates these Terms or any other applicable terms and conditions, rule, regulation, or directive of the Kansas Lottery or specific game rules.

If the Kansas Lottery suspects that you are engaging in any fraudulent, unlawful, or improper use of the Services, including, but not limited to, identity theft, fraud, or money laundering, we may immediately suspend your account or features within your account, including your ability to withdraw any funds, and report your activities to any third party, including law enforcement. We are not liable for any damages or losses resulting from our response to suspected unlawful activity.

Limited License and Use. You are granted a limited license to use the Services for their intended purpose only and in accordance with these Terms. We may revoke this limited license at any time. Your use of an account or the Services does not create any agency, partnership, trust arrangement, fiduciary relationship, joint enterprise, or other relationship between you and the Kansas Lottery.

Intellectual Property. The Kansas Lottery owns or has license to use all intellectual property appearing on the Services, including, but not limited to, all copyrights, trademarks, service marks, and trade dress. The Kansas Lottery owns or has the license to the rights to all content appearing on the Services, which includes, but is not limited to, images, pictures, graphics, photographs, animations, videos, music, audio, text, games, game mechanics, play methods, code, software, format, presentation, and organization. Your use of the Services confers no ownership rights or license to use any intellectual property or other content beyond the limited license for use granted in these Terms. Unless you have our express written consent, you agree not to:

  • copy, reproduce, modify, translate, create derivative works from, display, publish, distribute, transmit, or otherwise make the Services, their content, or any aspect thereof available to or through any third party;

  • copy, reproduce, redistribute, publish, reverse engineer, decompile, disassemble, make derivative works from any software, process, application, or source code used in providing the Services, their content, or any aspect thereof;

  • access or attempt to access source code for the Services, or their content;

  • sell, assign, sublicense, lease, or otherwise exploit the Services, their content, or any aspect thereof;

  • export any software used for the Services, their content, or any aspect thereof to any other jurisdiction or country by any means; or

  • use the Services or their content in a manner that would violate any of these Terms.

You are liable for any damages, costs, or expenses arising out of or in connection with your commission of any of the above. If you become aware of any third party committing any of the above, you agree to immediately notify us and to cooperate in any resulting investigation.

Change in Services. We reserve the right to add, remove, modify, suspend, or terminate the Services or any aspect of the Services at any time and without notice. We are not liable for any damages or losses resulting from any such changes.

III. ACCOUNTS

Applying for an Account. To request an account, you must provide all information requested on the registration form. This specifically includes, but is not limited to, your full legal name, physical address, date of birth, and the last 4 digits of your social security number. By submitting your request for an account, you represent and warrant that:

  • you are at least 18 years of age;

  • you are requesting an account in your own name;

  • you are using your own personal information;

  • the information you provide is true, complete, and accurate to the best of your knowledge;

  • you will keep your username and password confidential;

  • you do not already have an open account; and

  • you are not prohibited from gambling, purchasing lottery tickets, or otherwise using the Services.

The Kansas Lottery may require you to provide additional documentation through your PlayOn® account. The Kansas Lottery may require you to change or update account information at any time, including, but not limited to, your username and password. The Kansas Lottery does not guarantee that an application will be approved or that an account will be registered in any specific period of time. You are strictly prohibited from opening more than one account. The Kansas Lottery reserves the right to take whatever lawful actions we deem appropriate if the Kansas Lottery suspects you have more than one open account.

Age & Identification Verification. By submitting your application for an account, you consent to our use of any age-verification and identity-verification technology or method the Kansas Lottery deems appropriate. You may be required to provide additional documentation as evidence of your age and identification through your PlayOn® account. The Kansas Lottery does not guarantee that our age-verification and identity-verification technology and methods will be able to locate records for every person. Your application for an account will be denied if your age and identity cannot be verified. The Kansas Lottery is not liable for any damages or losses resulting from denial of your application.

Prohibition on Use of Temporary or Disposable Email Addresses. The Kansas Lottery uses the email address you provide to communicate with you, including for the purposes of establishing and authenticating your account. By using the Services, you confirm that any email address you use for the purposes of registering or maintaining your account is your own email address (associated with you, as an individual), and is not intended or designed to be a temporary or disposable email address. Failure to comply with this provision may result in the suspension or termination of access to the Services in accordance with these Terms.

Financial Institution Account Verification and Adverse Action Notice. When registering a payment method or bank account to be used for financial transactions on your account, you consent to our use of a service that will attempt to verify the existence and eligibility of that payment method or bank account to be used for deposits, withdrawals, or other platform functionality and confirm you are the owner or authorized user of that account. The Kansas Lottery does not guarantee that our account verification technology and methods will be able to locate records for every person. The addition of a payment method or bank account will be declined if it cannot be verified. The Kansas Lottery is not liable for any damages or losses resulting from denial of your application or registration. The Kansas Lottery relies on information provided by GIACT Systems, LCC (“GIACT”), a registered consumer reporting agency, prior to registering a bank account for any use of the Services and may decline the registration of the bank account or any transaction from or to that account based on the information provided by GIACT. Account Request Denials.
You understand and agree that an account is a discretionary privilege and that you have no right to an account. The Kansas Lottery reserves the right to reject a request for an account for any reason. The Kansas Lottery is under no obligation to explain the reason for delay in processing or denial of a request. The Kansas Lottery is not liable for any damages or losses resulting from any delay in processing or denial of your request.

Suspension & Termination. You understand and agree that an account is a discretionary privilege that the Kansas Lottery may suspend or terminate at any time, for any reason, and without notice. In the event of termination, funds in your account may be returned at the discretion of the Kansas Lottery, and in any event only after applicable withholdings and adjustments have been made. Following termination, any unclaimed prizes not subject to restrictions or forfeiture as defined by the Kansas Lottery, must be claimed in person at Kansas Lottery headquarters within the specified number of days per the type of game before the prize is deemed expired. For more information, see section VIII. It is your responsibility to provide accurate account information so that the Kansas Lottery may contact you if necessary. The Kansas Lottery is not liable for any damages or losses resulting from the inability to contact or locate you.

Responsible Gaming Exclusions. You may temporarily or permanently exclude yourself from using your account through the Kansas Lottery responsible gaming tools or by contacting the Kansas Lottery Support Center by calling 1-913-653-0028. During exclusion, you will not be able to participate in online play gaming activities, promotions or loyalty activities. You understand and agree that the Kansas Lottery may temporarily or permanently restrict access to your account if the Kansas Lottery deems it necessary to promote responsible gaming. An exclusion cannot be reversed during the exclusion period and any breach of an exclusion, including an attempt to open more than one account, will result in forfeiture of all winnings from purchases made during the exclusion period. After an exclusion period ends, you may be required to manually reactivate your account and your funding limit may be reduced. During exclusion, the Kansas Lottery will not directly send any marketing material to you.

Inactive Accounts. If you do not sign-in to your account for 36 consecutive months, and do not respond to attempts to be contacted for a period of 90 days after that, the Kansas Lottery may close your account as inactive and transfer any funds therein, minus any amount owed to the Kansas Lottery, to the Kansas State Treasurer in accordance with state unclaimed property laws. It is your responsibility to close your account in a timely manner. The Kansas Lottery is not liable for any damages or losses resulting from inactivity fees, closure of your account, or transfer of funds to the State Treasurer.

Closing Your Account. You may close your account at any time. The Kansas Lottery may require you to provide certain information through your account to verify your identity before closing your account. You are responsible for payment of any outstanding balance owed on your account. The Kansas Lottery does not guarantee a specific time by which your account will be closed.

IV. FUNDING YOUR ACCOUNT

Adding Funds. You may add funds into your account using any method that the Kansas Lottery has approved. Your account can be funded by credit card, debit card, or ACH when subscribed to the VIP Preferred ACH bank transfer service. The Kansas Lottery reserves the right to change the approved methods of payment without notice. By initiating an account funding transaction, you represent and warrant that you:

  • are physically located in Kansas at the time of adding funds;

  • have authority to use the payment source and method you select;

  • have the authority to use the funds for the purpose of adding funds into your account;

  • are not using a payment source that lists an individual unable to provide consent as a joint account holder or an authorized user;

  • are not adding funds derived from any fraudulent or unlawful source;

  • will not attempt to reverse, charge-back, block, cancel, or in any way attempt to prevent the Kansas Lottery from receiving the funds added;

  • consent to the Kansas Lottery sharing your personal information with any third parties that is used to process your requested funding; and

  • consent to the Kansas Lottery performing any background check or investigation deemed necessary to ensure that your payment source and method are authorized.

You agree that the Kansas Lottery is entitled to rely on the information provided, or otherwise authorized to be provided, by you and on the representations made by you under these Terms. The Kansas Lottery may require you to provide additional documentation through your account. The Kansas Lottery does not guarantee that funds added will be processed and made available in any specific period of time. The Kansas Lottery does not guarantee that funds added to your account will be free from error. The Kansas Lottery reserves the right to deny any funding at any time and without notice. The Kansas Lottery is not liable for any damages or losses resulting from any delay, denial, or error in processing the addition of funds to your account.

Open Banking Services. The Kansas Lottery may approve the use of payment methods that require compliance with Open Banking Services terms and conditions provided by Finicity, a Mastercard Company. If you use the Finicity Open Banking Services, you consent to and agree to be bound by and comply with the Finicity terms and conditions for the use of the service. If you do not agree to the Finicity terms and conditions, you cannot use the Open Banking Services.

Third-Party Transaction Fees and Penalties. You agree to abide by all applicable terms and conditions required by your financial institution or payment processor. You are solely responsible for any transaction fees or penalties of any kind imposed by any financial institution, payment processor, or other third party associated with processing your transaction. You are required to reimburse the Kansas Lottery for any losses the Kansas Lottery suffers as a result of any transaction fees or penalties of any kind associated with your transaction. You hereby authorize the Kansas Lottery to hold and collect any amount owed to the Kansas Lottery as a result of any such fees or penalties from your funds added or winnings. The Kansas Lottery reserves the right to pursue any other means to recover such losses.

No Withdrawal or Transfer of Funds Added. Unless required by law, funds you add into your account cannot be withdrawn, returned, charged-back, re-credited, or transferred to another account. It is your responsibility to refrain from adding more funds than you intend to use. You agree that you will not attempt to deny, reverse, charge-back, re-credit, block or otherwise attempt to invalidate, recover, or deny the Kansas Lottery receipt of funds added. You hereby authorize the Kansas Lottery to hold and collect any amount owed to the Kansas Lottery as a result of any such fees or penalties from your added funds or winnings. The Kansas Lottery reserves the right to pursue any other means to recover such losses.

Minimum & Maximum Funding. The Kansas Lottery reserves the right to set or change a minimum required and/or maximum allowed amount of funds that can be added to your account at any time and without notice. The Kansas Lottery is not liable for any damages or losses resulting from setting or changing any minimum or maximum funding amount.

Transaction History. You understand and agree that the Kansas Lottery may record and store any transactions you conduct through the Services. A transaction history is also available for you to view through your account. This history is provided as a convenience only. It is not an official record. Information appearing in the transaction history does not constitute and does not establish a transaction, winning ticket, or prize. The Kansas Lottery does not guarantee the accuracy of information appearing in your account transaction history. It is your responsibility to notify the Kansas Lottery of any errors in your transaction history. The Kansas Lottery is not liable for any damages or losses resulting from your reliance on or failure to report errors in your transaction history.

Balance Errors. In the event that any funds are mistakenly credited to or deducted from your account, the Kansas Lottery is entitled to make the appropriate adjustments. You must notify the Kansas Lottery immediately if any funds are incorrectly credited to or deducted from your account. If you withdraw any funds incorrectly credited to your account, the Kansas Lottery may withhold that amount from any added funds or prize or seek recovery. If you use any funds incorrectly credited to your account to purchase a lottery ticket, the Kansas Lottery may deem the purchase void and refuse to pay any prize or recover any prize already paid.

No Interest on Funds. You will not receive any interest of any kind on funds added or held in your account, including any claimed or unclaimed prizes. It is your responsibility to only add funds to your account that you intend to use and to claim and withdraw prizes in a timely manner.

V. LOYALTY, BONUSES AND PROMOTIONAL OFFERS

General. Kansas Lottery may offer special promotional offers for players. Each promotion is subject to its own supplemental terms and conditions, to be determined by the Kansas Lottery. Players who do not want to receive any promotional offers should opt out of communications by updating their preferences in their account. Promotional offers are discretionary, and players have no right to receive or redeem any specific offer. Promotional offers may be cancelled at any time and without notice. If there is a discrepancy between information in a player's account and an offer notification, the information in the player's account shall prevail. The Kansas Lottery is not liable for any damages or losses resulting from any delay, error, or failure to accept or qualify for any promotional offer.

Online play credit bonuses that are awarded to players cannot be cashed out.

Daily promotional offers will run for 24 hours, unless stated otherwise. Any qualifying requirements such as logging in, playing, or adding funds, must be met by the time specified in the offer.

Free Games. Players might be offered free games for online play from time to time. The requirements for getting “Free Games” will be stated by the Kansas Lottery and may include logging in, purchasing a lottery ticket, playing a minimum number of plays on a specific game/games, or adding specific funds to one's account. Free Games have no cash value and cannot be exchanged for real money. Free Game offers may be limited to one game or a combination of games and cannot be changed by the player. The denomination of each Free Game cannot be changed by the player. Free Games expire 48 hours after they are granted to a player, unless expressed otherwise in the promotion. Free game bonuses will always expire at the top of the hour.

Free Play Credit. Players may be offered a fixed amount of “Free Play Credit” for online play, not to exceed $200, or a percentage of Free Play Credit based on a requirement to be set by the Kansas Lottery, such as adding funds, or logging in. Free Play Credit has no cash value and cannot be cashed out. Free Play Credit expires 14 days after it is granted to a player, unless expressed otherwise in the promotion. Free Play Credit will always expire at the top of the hour.

Cash Credit. Players may be offered a fixed amount of “Cash Credit”, not to exceed $200, or a percentage of Cash Credit based on a requirement to be set by the Kansas Lottery, such as adding funds, or logging in. Cash Credit is treated as a prize and can be cashed out. Cash Credit does not expire.

Bonus Codes. Some players may receive a “Bonus Code” for online play, which will entitle them to Free Games or Free Play Credit upon creating an account or adding funds. Bonus Codes are limited to 1 use per player and can expire at any time. Each Bonus Code has its own supplemental terms and conditions, to be managed at the Kansas Lottery's discretion.

Promo Codes. Some players may receive a “Promo Code” for loyalty, which will entitle them to “Free Points” upon creating an account or entering into the loyalty program to collect points. Promo Codes are limited to 1 use per player, unless expressed otherwise in the promotion and can expire at any time. Each Promo Code has its own supplemental terms and conditions, to be managed at the Kansas Lottery's discretion.

Welcome Offer. Offer valid for new registrations only. If funding or match up offers are included, the player must meet the minimum funding and/or shopping cart purchase requirements. Offer only valid on the first funding/deposit or first time draw game purchase up to $50 before the expiration. “Bonus Matchup Free Play Credit” expires 14 days after it is granted to a player, unless expressed otherwise in the promotion. If Free Games are offered, they expire 48 hours after they are granted to a player, unless expressed otherwise in the promotion. If Points are offered, they will expire one year after award. Bonuses will always expire at the top of the hour.

Collecting Points. Account holders earn Points by adding funds to a digital wallet or making a direct purchase of a draw game with new funds, entering eligible Kansas Lottery tickets, including instant, pull-tab, “Fast Play” and draw game tickets, through the PlayOn® website or the PlayOn® mobile app or by participating in other promotional events and activities offered by the Kansas Lottery. You are limited to entering a total of fifty (50) tickets per day, which include game tickets for any second-chance drawing promotions.

Points have no monetary or property value nor are Points necessarily directly associated with the face value of tickets entered. Point value will be revealed upon the successful submission of each eligible ticket or completion of a promotion or activity. Each eligible ticket has a point value based upon a range of values assigned by the Kansas Lottery and are subject to change. Points are not transferable for any reason, including upon death of an account holder or in property settlement. Point balances from more than one account will not be combined.

The Kansas Lottery will attempt to credit your account with Points on a timely basis. Points earned from draw game tickets that are cancellable such as Super Kansas Cash, Pick 3, and Keno, will usually be available for credit the calendar day after the purchase of the ticket. You will have the responsibility of ensuring that your Points are properly credited. Any claim for Points not credited accurately must be submitted by email via the CONTACT & SUPPORT link within five (5) days of the date of claimed accrual of such Points. The Lottery shall have no liability for any printing, production, typographical, mechanical or other errors in these Terms, or in the Points summaries or accounts.

The Kansas Lottery reserves the right to invalidate Points and/or entries into any drawings if the Kansas Lottery determines in its sole discretion that such Points were obtained in any of the following ways: fraudulently, improperly, from tickets deemed lost or stolen, tickets not sold pursuant to the Kansas Lottery Act or any Kansas Lottery rules and regulations, or earned from a submission that is deemed to contain any inappropriate content. Inappropriate content includes, but is not limited to, any content that:

  • infringes upon or violates the copyrights, trademarks or other intellectual property rights of any person or entity

  • is libelous or defamatory

  • contains any nudity, is obscene, pornographic, sexually explicit, or vulgar

  • violates a person's right to privacy

  • violates any local, state, national, or international law

  • contains or advocates illegal or violent acts

  • degrades others on the basis of gender, race, class, ethnicity, national origin, religion, sexual orientation, political belief, disability, or other classification

  • is predatory, hateful, stalking, or intended to intimidate or harass, or contains derogatory name-calling

  • impersonates others

  • is in poor taste or is otherwise objectionable

The Kansas Lottery also reserves the right to suspend and/or terminate your account if the Kansas Lottery suspects that you have engaged in any misrepresentation or fraudulent activities, or failed to comply with these Terms or any rules associated with the Program. Upon termination of your account, you forfeit any Points accrued to date. The Kansas Lottery reserves the right to require proof of accrual of Points as well as the right to delay the processing or redemption of any Points without notice to you in order to assure compliance with these Terms. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer and/or mobile device and activity on your account, and you agree to accept responsibility for all activities that occur under your account or password.

Redeeming Points. You may redeem Points for entries/plays in the drawings, instant win games and other offers ("Rewards") listed. To spend/redeem your Points, you can click on the "Rewards" link in the tab and follow the links and instructions to browse through the currently available drawings and other offers. Once you have located a Reward you would like to enter/play, you can redeem Points by clicking on the link for the particular Reward. You will receive confirmation that you have received an entry into the drawing or awarded the reward and the associated Points will be deducted from your account.

The total number of Points you can use to obtain Rewards is limited to the number of Points you have available in your account. All Point redemptions for Rewards from the Rewards Catalog are final and the Points will be deducted immediately from your account. Any Points not used within one (1) year after credit to an account shall expire and be forfeited without compensation.

The Kansas Lottery reserves the right to modify the drawings available for participation in, as well as their corresponding Point values, at any time for any reason. Point redemptions for drawing entries and other rewards are final and the Points will be deducted immediately from your account. The odds of you being selected to win a prize in each drawing depend upon the number of entries (received through Points) from all account holders. Unless otherwise specified by Kansas Lottery rules and regulations, drawing entries are eligible for one drawing only. You may win no more than one prize in any drawing. Points used for drawing entries may not be cancelled or returned.

The Kansas Lottery or its designee shall attempt to contact each drawing winner via the telephone, email address and/or mailing address provided by you via your account. You forfeit any prize if the Kansas Lottery or its designee is unable to contact the winner, or the winner fails to claim a prize within the specified period as determined by the Kansas Lottery. In cases of forfeiture, the Kansas Lottery may replace the winner with an alternate, and if so, the replaced account holder who was previously selected as a winner is no longer entitled to the prize.

Each drawing and Reward has supplemental terms and rules associated with it, which are published on the Kansas Lottery website.

Refer A Friend. To participate, you can use the referral link available on the PlayOn® website or PlayOn® mobile app. An eligible referral is a bona fide resident of the United States or a United States territory who is at least eighteen (18) years old and who does not currently have an active account. Each eligible referral will result in bonus Points awarded to the new registrant and the referring account holder. The number of bonus Points awarded may change from time to time, and the current values will appear on the Lottery website. A referred registrant must use the referral link provided by the referring account holder for either account to receive bonus Points. Only the first three (3) referral registrations per calendar month will be eligible to earn bonus Points.

You may not attempt to make referrals by providing names of people you do not personally know, such as by sending unsolicited e-mails, by posting on sites in a manner that violates the terms of use of those sites, or by providing false information.

Promotion Disputes. All questions or disputes regarding eligibility for any PlayOn® activities and/or promotions, or account compliance with these Terms will be resolved by the Kansas Lottery in its sole discretion.

VI. GEO-LOCATION

Location Requirement. You must be physically located in Kansas to add funds into your account or to purchase a ticket through the Services. Any funds added, purchase of a ticket, or attempt to add funds or purchase a ticket through the Services while physically located outside of Kansas is strictly prohibited and may violate state or federal law. You understand and agree that any ticket purchased while physically located outside of Kansas is void and that you waive any claim to a prize or any portion of a prize you may have won. If it is determined that you added funds or purchased a lottery ticket through the Services while located outside of Kansas, the Kansas Lottery reserves the right to deem your funds invalid, purchase invalid, refuse to award a prize, reclaim a prize that has been awarded, terminate your account and/or refer the matter to law enforcement where applicable.

Geo-Location Technology. The Kansas Lottery uses a variety of geo-location technology and methods to verify your location. Any use of software or other methods intended to provide a false location is prohibited and may violate state or federal law. The Kansas Lottery does not guarantee that our geo-location technology will verify the location of every person physically located within Kansas. If the Kansas Lottery is unable to verify that you are physically located within Kansas, your access will be blocked, and you will be prohibited from adding funds or purchasing any online tickets through the Services. The Kansas Lottery is not liable for any damages or losses resulting from your inability to access or make a purchase on the Services.

Standard Location Check. By registering for and using an account or the Services, you consent to have your location verified by the Kansas Lottery’s standard geo-location check. The Kansas Lottery standard location check is automatically activated anytime you attempt to log into your account and use the Services. Your location will not be checked after you disconnect from the Services or log out of your account.

Mobile Location Service. In some cases, your location may need to be verified through your browser location services. Your location will only be obtained from the browser with additional consent from you. If verification through your browser is required, a message will appear when you try to add funds into your account or purchase a lottery ticket online through the Services. To consent and opt-in to the browser-location service, press the “Allow” button on the message.

Location Privacy. Your privacy is extremely important to the Kansas Lottery. Information relating to your location and/or the location of your mobile device may be shared with the Kansas Lottery contractors, sub-contractors, affiliates, and other third parties for a variety of reasons including but not limited: (1) providing the product, service, or transaction you requested, (2) legal purposes, and (3) marketing purposes. Due to Kansas Lottery prize validation requirements, a record confirming your location may be retained for at least 14 months.

VII. PURCHASING TICKETS

Purchases. Initiating any purchase through the Services constitutes your consent to deduct the cost of that purchase from your account. Purchases will first be deducted from available bonuses. If no bonuses exist, purchases will be deducted from funds added to your account. If no added funds exist, purchases will be deducted from prizes in your account. The Kansas Lottery does not guarantee the timeliness of any purchase and reserves the right to refuse any attempted purchase for any reason. The Kansas Lottery is not liable for any damages or losses resulting from any delay in or denial of processing a purchase.

All Sales Are Final. You are solely responsible for ensuring that you have selected the correct online lottery game and all options relating to that game, including, but not limited to, game ticket, number of tickets, price of ticket/s, and numbers played on a ticket or tickets. All sales are final, and purchases made in error will not be refunded. The Kansas Lottery is not liable for any damages or losses resulting from any error you make in selecting your purchase.

Games Offered. The Kansas Lottery does not guarantee that any specific Kansas Lottery online game will be offered through the Services. The Kansas Lottery may limit purchases of any game, ticket, and/or purchase on a particular set of numbers at any time and without notice. The Kansas Lottery may terminate a game at any time and without notice. The Kansas Lottery is not liable for any damages or losses resulting from any purchase limitations or game termination.

Game Disputes. All tickets, transactions, and claims are subject to Kansas Lottery rules, regulations, directives, state and federal law, and any prospective changes thereto. Printouts, photographs, screenshots, and other images are not, and will not, be accepted as evidence of a ticket purchase or outcome. The only evidence of a ticket purchase or outcome is the data contained in the Kansas Lottery system that passes all security tests, including, but not limited to, verification against third-party systems and transaction history. In questions involving ticket validation, the Kansas Lottery’s determination is final. In cases of dispute for any reason, the Kansas Lottery may at its sole discretion, replace the disputed ticket with an unplayed ticket of equal value or refund the retail price. The Kansas Lottery’s decision to replace or refund a ticket is the player’s exclusive remedy.

VIII. CLAIMING PRIZES

Claims in General. Subject to these Terms and all applicable state and federal law, prizes won through the Services may be claimed as follows:

  • prizes of $599.99 or less are automatically credited into your account;

  • prizes of $600 and greater and up to and including $399,999.99 must be claimed through the Kansas Lottery Account online portal;

  • prizes of $400,000 and greater must be claimed in person at Kansas Lottery headquarters; and

  • annuity prizes must be claimed in person at Kansas Lottery headquarters.

Before payment of any prize, the Kansas Lottery may require you to provide additional documentation through your account. The Kansas Lottery may change available methods for claiming a prize at any time and without notice. If the Kansas Lottery suspects any unlawful conduct or violation of these Terms, the Kansas Lottery may withhold payment of a prize pending completion of an investigation. You agree to cooperate with the Kansas Lottery in any investigation. The Kansas Lottery does not guarantee payment of a prize within any specific period of time. The Kansas Lottery is not liable for any damages or losses resulting from any delay in payment of a prize.

Online Claim Form. You will be required to complete and/or upload a claim form to claim a prize of $600 or more. By checking the boxes on this form, you represent and warrant that: you are the registered user of the account; your account information is accurate; and you accept the Kansas Lottery claim policy. You further certify that you: are a US person, have provided your correct social security number, or individual taxpayer identification number; are not subject to backup withholding; and are not subject to the Foreign Account Tax Compliance Act (FATCA). You understand and agree that checking these boxes constitutes your electronic signature.

Backup Withholding. Backup withholding refers to the process by which a person or entity making payments to you must, under certain conditions, withhold and pay a percentage of such payments to the IRS. Your prize may be subject to backup withholding if you do not provide your correct social security number or individual taxpayer identification number to us, you do not certify your social security number or individual taxpayer identification number when required, the IRS notifies the Kansas Lottery that you furnished an incorrect social security number or individual taxpayer identification number, the IRS notifies you that you are subject to backup withholding because you did not report all of your interest and dividends on your tax return, or you do not certify to us that you are not subject to backup withholding. Foreign Account Tax Compliance Act (FATCA).
The FATCA requires US taxpayers to report certain foreign financial accounts and offshore assets. It also requires certain foreign financial institutions to report all US account holders who are specified US persons. To learn if you own foreign financial assets subject to the FATCA or if you qualify for an exemption from the FATCA, please refer to the IRS website at www.irs.gov.

Claiming in Person. If you are required to claim a prize in person at Kansas Lottery headquarters, you will be required to provide a valid government issued picture identification and proof of your social security number in conformance with the State of Kansas requirements. The Kansas Lottery may deposit a prize won through the Services into your account even if the prize was claimed in person. To verify you are presenting acceptable identification please view acceptable documents at playonkansas.com.

Tax Obligations. A lottery prize is considered income and a taxable event when claimed or received. The Kansas Lottery reports all prizes of $600 and greater to the IRS and the State of Kansas. A Form W-2G or 1142 as applicable is generated for all prizes of $600 and greater and made available to you through your account. The Kansas Lottery is required to withhold state and federal tax from all prizes over $5,000. These withholdings are estimates only and do not necessarily satisfy the tax liability. It is your responsibility to immediately inform the Kansas Lottery if you believe there is an error in reporting or withholding. You are solely responsible for properly reporting and paying your applicable local, state and federal taxes. The Kansas Lottery is not liable for any damages or losses resulting from your failure to properly report or pay any local, state or federal taxes.

Online Lottery Winnings Intercept. Before paying any prize of $600 or greater, state law requires the Kansas Lottery to check for any debts submitted to the State Set Off Program such as child support arrearages. If any such debts exist, the Kansas Lottery is legally required to offset your prize by the amount of the debt as specified by the State of Kansas Setoff Program. If you believe that prize money was withheld for a debt that has already been paid, it is your responsibility to contact the agency reporting the debt and seek reimbursement. The Kansas Lottery is not liable for any damages or losses resulting from any offset from a prize for payment of a debt.

Claim Errors. A Kansas Lottery online claim may not be premised on human or electronic error in the communication, display, or transmission of data regardless of how that data is recorded, displayed, or transmitted. A claim may not be premised on any intentional human, electronic, or other form of communication or transmission that was not authorized by the Kansas Lottery. The Kansas Lottery is not liable for any damages or losses resulting from any erroneous or unauthorized communication, display, or transmission of data.

Failure to Claim a Prize. An online prize must be claimed within 180 days of the date that it was won. Any online prize that is not claimed within 180 days will be deemed unclaimed and disposed of in accordance with state law. It is your responsibility to properly claim your prize within 180 days. The Kansas Lottery is not liable for any damages or losses resulting from your failure to properly claim your prize.

IX. WITHDRAWING PRIZES

Prize Withdrawals Only. You may withdraw prizes in your account. You may not withdraw money added to fund your account unless required by law. It is your sole responsibility to not add more funds than you intend to use.

Withdraw Methods. You must have a valid U.S.-domiciled bank account to withdraw prizes to. Prizes may only be withdrawn by bank ACH transfer, or other method the Kansas Lottery approves. Prizes at or above $50,000 but below $400,000 will be automatically withdrawn to your default withdrawal method. You may initiate a withdrawal through your Kansas Lottery account. By initiating a withdrawal, you consent to the Kansas Lottery: deducting the withdrawal amount from your account; retaining any amount owed to the Kansas Lottery under these Terms; and sharing your personal information with any third parties the Kansas Lottery uses to process your request. The Kansas Lottery is not required to use any specific method, bank, or payment processor that you identify. You cannot make any withdrawal, including any prize amount, until you have successfully added verified funds to your account at least once. The Kansas Lottery does not guarantee that withdrawals will be processed in any specific period of time. The Kansas Lottery is not liable for any damages or losses resulting from delay in processing a withdrawal.

Additional Documentation. Before processing a withdrawal, the Kansas Lottery may require you to provide additional documentation through your Kansas Lottery account. You may also be required to complete additional claim forms and/or certify documentation detailing your funding, withdrawals, and other account transactions.

Investigative Holds. You understand and agree that the Kansas Lottery may hold any withdrawal if it is suspected that you may be engaging in or have engaged in fraudulent, collusive, unlawful, or improper activity pending completion of an investigation. You agree to cooperate in any investigation into such activity. You understand and agree that your refusal to cooperate with an investigation may lead to terminating the account and forfeiting all account balances. The Kansas Lottery is not liable for any damages or losses resulting from any delay or denial of a withdrawal resulting from an investigation.

X. OTHER

Privacy & Security. The Kansas Lottery is committed to safeguarding the information collected through the Lottery’s online portals. The Kansas Lottery takes your privacy seriously and will diligently endeavor to keep your private information confidential. The Kansas Lottery will only share personal information about you with others in accordance with these Terms and law, to perform a transaction you have requested; if we have your consent; if we need to protect our rights or property; or if authorized or required to do so by law. Security measures have been integrated into the design, implementation, and day-to-day operations of the Services as part of the Kansas Lottery’s continuing commitment to the security of electronic content. The Kansas Lottery does not, however, guarantee that any communication or information will be secure or free from unauthorized access by third parties. Your use of the Services is at your own risk. The Kansas Lottery is not liable for any damages or losses resulting from a security breach except as required by law.

Winner Information. If you win a prize of $600 or greater, you understand and agree that the Kansas Lottery may use your first name, city, and prize amount for promotional, advertising, and/or publicity purposes. You understand and agree that the Kansas Lottery may freely use, reproduce, and display this information, in whole or in part, alone or together with other information, through any and all forms of media, in any manner, anywhere, in perpetuity, and without restriction, reservation, or limitation.

Communications from the Kansas Lottery. The Kansas Lottery may use your account information to contact you by direct mail, email, text message, and/or telephone regarding use of your account and transactions. You may also opt-in to receive promotional material and winning numbers. You may unsubscribe to these services by following the instructions contained in the emails or text messages.

Disruptions. Access to the Services or your account may be unavailable, delayed, limited, or slowed by various disruptions. The Kansas Lottery does not guarantee that the Services, or your account will be uninterrupted, free from delay, or continuously available. The Kansas Lottery is not liable for any damages or losses resulting from any disruption, delay, or unavailability of the Services, or your account.

Disclaimer of Warranties. The Services and your account are offered on an “as is” basis. The Kansas Lottery makes no warranties of any kind, implied or express, including, but not limited to, warranties of title, merchantability, fitness for a particular purpose, or non-infringement. Use of the internet carries inherent risks and dangers. The Kansas Lottery does not guarantee the Services or your account are free from these inherent dangers, including, but not limited to, viruses, spyware, malware, or other invasive, malicious, or damaging software, code, or applications of any kind. Nor does the Kansas Lottery guarantee use of the Services or your account will not cause damage or loss of any kind. The Kansas Lottery is not liable for any damages or losses of any kind resulting from your use of the Services or your account, or for any actions by third parties.

Unauthorized Use. The Kansas Lottery is not liable for any damages or losses resulting from a third party’s unlawful or unauthorized use of your account. The Kansas Lottery is not liable for any damages or losses resulting from a third party’s unlawful or unauthorized use of any payment source or method, including, but not limited to, debit cards, regardless of whether the payment method is under investigation or whether any card has been reported stolen. It is your responsibility to keep your username, password, and other account information confidential. If your username and password were entered correctly, the Kansas Lottery is entitled to assume you are the person using your account. You are responsible for any charges, costs, expenses, damages, liabilities, and losses of any kind that you, the Kansas Lottery, or any third party may incur as a result of your failure to keep your account information confidential. It is your responsibility to immediately notify the Kansas Lottery if you suspect or discover that your account has been compromised. You agree to cooperate with any investigation into unauthorized access of your account.

Limitation of Liability. The Kansas Lottery is not liable for, and you expressly waive any claim for, any printing or computer error; any omission, interruption, irregularity, deletion, defect, or delay in the Services, or your account; any theft, destruction, unauthorized access, or alteration of any network, equipment, computer, data, information, or property; any hardware or software malfunctions of any kind; any inaccurate transmission of content due to technical problems or traffic congestion on the internet, at any website, native application, or any combination thereof. Under no circumstances is the Kansas Lottery liable for any direct, indirect, incidental, special, or consequential damages arising out of your use of the Services, its content, or your account, even if the Kansas Lottery has been advised of the possibility of such damages.

The Kansas Lottery is not responsible for information that account holders choose to communicate to other users on the PlayOn® website or the PlayOn® mobile apps, or for the actions of other players. Once you post or send any content to the PlayOn® website or the PlayOn® mobile app, the Kansas Lottery is expressly granted the complete and irrevocable right to quote, re-post, use, reproduce, modify, distribute, transmit, broadcast, and otherwise communicate, and publicly display and perform the content in any form, anywhere, with or without attribution to the your identity, and without any notice or compensation to you of any kind. Please note that all of the information collected on this website or related apps may be public record and may be subject to inspection and copying by members of the public, unless an exemption or other protection in the law exists.

YOU EXPRESSLY AGREE THAT THE USE OF THE KANSAS LOTTERY PlayOn® ONLINE PLAY AND PLAYERS LOYALTY PROGRAM WEBSITE, PlayOn® MOBILE APP AND THE INTERNET IS AT YOUR OWN RISK. The laws of the State of Kansas govern these Terms and membership in PlayOn®.

Non-Waiver. The Kansas Lottery is not obligated to take any action or pursue any remedy authorized by these Terms. Refraining from taking any authorized action or pursuing any remedy does not constitute a waiver of any rights or remedies and does not preclude the Kansas Lottery from taking any such action or pursuing such remedy in the future.

Severability. If any provision of these Terms is deemed unlawful or unenforceable for any reason, that provision will be severed from these Terms and the remaining provisions remain in full force.

Governing Law. All transactions and claims covered by these Terms are subject to the laws of the State of Kansas, the rules, regulations, and directives of the Kansas Lottery, and any subsequent changes. You understand and agree that any dispute arising out of your use of the Services or your account is governed by the laws of Kansas. You further understand and agree that federal and state courts within Kansas have exclusive jurisdiction over any claims arising out of your use of the Services or your account.
